Title Deeds in Georgia: Legal Ownership & Caveat Registration for Foreigners
Safe investing relies on solid legal registration, not developer promises. Meet the Georgian Land Registry — one of the most transparent in the world. See how the "Caveat Note" early on protects your payments securely.
Buy Real Estate, Not "Air Rights"
When a private investor with a $70,000 to $300,000 portfolio looks at overseas real estate, one of the first red flags to watch for is the ownership model. The market is full of investment funds, purchasing groups, and complex legal structures (like REITs) where the investor buys a "share" or "right" in a company, but is not the direct owner of the walls and land.
At MY Invest, our legal strategy dictates there is no substitute for Direct Ownership. When you invest in a premium project in Batumi, the goal is singular: the property must be registered in your name only, in the government Land Registry (Tabu), independent of any third party. To ensure this, Georgian law provides foreign investors with an exceptionally transparent, fast, and advanced registry system.
The First Step: Caveat Registration From Dollar One
Legal protection of your capital begins long before the project is finished. The moment you select a property, sign a sales contract with the developer, and transfer the first payment (the down payment), the most important legal action of the deal takes place: registering a Caveat (warning note) in your favor in the Georgian Land Registry.
This caveat is recorded in the property's public registry extract. The legal implication is absolute: the moment the note is registered, the developer is completely blocked. They cannot sell the property to anyone else, cannot pledge it for loans, and cannot perform any proprietary action without your explicit consent. Your capital has "locked" the asset.
Full Title Deed: Final Ownership Registration
Completing the transaction and moving to full ownership is a precise mathematical process. The full ownership registration in the Georgian Land Registry (Title Deed) under your name will be executed immediately after you complete 100% of the payment for the property (according to the payment schedule or upon construction completion).
From the moment payment is complete, the property passes into your exclusive ownership. You are free to rent it out (whether through an external management company, an international brand hotel pool, or independent management), sell it on the free market whenever you choose, or bequeath it.
Technological Transparency: The Georgian Land Registry
One of the main reasons foreign capital flows to Georgia is the near-zero bureaucracy. While registering a property in many Western countries can take long months and incur hefty fees, Georgia is considered a global pioneer in land registration.
The Georgian Land Registry system is partially based on Blockchain technology, ensuring absolute transparency and zero possibility of forgery. The registration process itself (of the caveat or the final title) typically takes only 2 to 4 business days, and the registry extract is available for online review at any moment.
